General Terms and Conditions for Seminars at Hotel Sailer
1. Scope
These General Terms and Conditions (GTC) apply to all contracts for the use of seminar rooms as well as other services and deliveries by Hotel Sailer (hereinafter referred to as the "Provider"), unless otherwise agreed in writing.
2. Conclusion of Contract
A contract is formed with the written acceptance of the customer's application by the Provider. The acceptance must be made within 14 days of the application to be valid.
3. Services, Prices, Payment, Billing
The services owed are as specified in the booking confirmation and these GTC. Prices are in EURO including value added tax, excluding explicitly agreed extras. Price adjustments due to legislative changes will be clearly communicated. Deposits for major events are defined in advance and recorded in writing.
4. Setup and Dismantling Times for Events
The use of the premises for setup and dismantling outside the agreed times requires prior discussion and agreement with the seminar department. Any additional costs will be transparently communicated. We would like to kindly remind you that the seminar room should be cleared promptly after the end of the event. We are happy to provide advice and support for the smooth planning and execution of your event.
5. Cancellation by the Provider
The Provider may cancel the contract under certain conditions (non-compliance with contractual terms, damage to reputation, insolvency of the customer, force majeure). In these cases, there is no right to compensation. Written notification is required.
6. Cancellation by the Customer (Withdrawal)
The following cancellation fees apply exclusively to the turnover of the seminar. Please note that separate cancellation conditions apply for room reservations, as outlined in section 8. The seminar cancellation costs are staggered as follows, depending on the expected total turnover of the event:
For turnover up to €500:
Up to 14 days before the event: 50% of the agreed costs are due as a cancellation fee.
From 5 days before the event: 100% of the agreed costs are due as a cancellation fee.
For turnover from €501 to €1,000:
Up to 21 days before the event: 50% of the agreed costs are due as a cancellation fee.
From 20 to 14 days before the event: 70% of the agreed costs are due as a cancellation fee.
From 5 days before the event: 90% of the agreed costs are due as a cancellation fee.
For turnover over €1,000:
Up to 45 days before the event: 50% of the agreed costs are due as a cancellation fee.
From 44 to 30 days before the event: 70% of the agreed costs are due as a cancellation fee.
From 5 days before the event: 90% of the agreed costs are due as a cancellation fee. Cancellations must always be made in writing. The cancellation fee is calculated based on the expected total turnover of the event.
7. Changes in the Number of Participants and Event Times
Changes must be reported at least 3 days before the event. If the actual number of participants exceeds the last reported number, the invoice will be adjusted based on the higher number of participants. If the actual number of participants is lower than the last reported number, the invoice will still be based on the last reported number of participants.
If the minimum number of participants is not met, the offer will be recalculated.
Please note that additional technical equipment, dinners, room reservations, and services provided by third parties are not included in the minimum turnover.
8. Conditions for Room Reservations
If you have booked rooms for your event, separate reduction and cancellation conditions apply, as follows:
- Up to 21 days before the event: no cancellation fee.
- 20 to 10 days before the event: 30% of the costs for the room reservation.
- 9 to 1 day before the arrival date, 2 rooms from the remaining room contingent can be cancelled free of charge.
- No-shows will be charged 100% of the total accommodation costs. The above cancellation conditions apply to room reservations of up to 20 rooms. For reservations of more than 20 rooms, separate cancellation fees apply, which must be agreed individually. Please contact the seminar department of Hotel Sailer for further details and specific agreements regarding larger room reservations.
9. Payment of Invoices
All invoices are to be paid within 7 days of the invoice date to our account:
Raiffeisen-Landesbank AG, IBAN: AT2136 0000 0000 67 1800, SWIFT: RZTIAT 22, quoting the invoice number.
If invoice amounts remain unpaid for more than 30 days, the hotel reserves the right to charge 9.20% of the amount per month or the highest legal default interest. All costs incurred in the collection process are to be borne by the organizer.
10. Liability of the Customer for Damages
The customer is liable for damages caused by participants or third parties. Immediate notification of such damages is required.
11. Data Protection Regulations
The provider commits to complying with the GDPR. Customer data is used exclusively for contractual purposes.
12. Code of Conduct
Participants must adhere to the house rules. In the case of violations, the provider may exclude individuals from the event.
13. Technical Equipment and Third-Party Services
All third-party services must be coordinated with the seminar department in advance. The customer is responsible for their coordination and supervision.
14. Accessibility
The hotel strives to ensure accessibility for all guests. Specific needs should be registered in advance.
15. Adjustments to Health Risks
The hotel reserves the right to adjust measures and conditions related to health risks.
16. Written Form
Changes to the contract require written form. Emails satisfy this requirement.
17. Jurisdiction
For disputes, the court with material jurisdiction in Innsbruck has exclusive jurisdiction. Austrian law applies.
18. Force Majeure
In the event of force majeure, contractual obligations are nullified. Parties are not obliged to perform. Force majeure includes: war, occupation, riot, strike, complete collapse of supply facilities, complete cessation of air traffic (excluding weather conditions or strikes), cancellation of the fair due to Covid, however, only if the hotel and its operation are directly affected.
